UPDATE: SES STATEMENT ON OPERATING ADDITIONAL SATELLITE SPECTRUM AT THE 28.2/28.5 DEGREES EAST ORBITAL ARC

Luxembourg, 16 September 2013 – SES has been granted rights to use German Ku-band orbital frequencies at the 28.5 degrees East orbital position effective from October 4, 2013 onwards pursuant to a 2005 agreement with German media service provider, Media Broadcast (“MB”) (as successor to T-Systems Business Services). MB holds a licence for these frequencies issued by the Bundesnetzagentur, the German regulator, on the basis of German filings that have priority under the rules of the International Telecommunication Union.

The agreement will give SES the right to use, on its fleet, 500 MHz of bandwidth at this orbital position adjacent to SES’s 28.2 degrees East in the frequency bands 11.45 – 11.70 GHz and 12.50 – 12.75 GHz in downlink and 14.00-14.50 GHz in uplink. SES has procured and will launch and operate new satellites (ASTRA 2E and ASTRA 2G, where launch is currently scheduled for this and next year, respectively) at the 28.2/28.5 degrees East orbital arc, along with the ASTRA 2F satellite which was launched last year, to replace SES’s existing fleet at 28.2 degrees East and to provide new capacity. The new satellites in this neighbourhood will use the additional frequency spectrum as of October 2013 for DTH satellite television services in the U.K. and Ireland and for other services inside and outside of Europe.

Eutelsat is currently operating these frequencies on the Eurobird-1 satellite (also known as Eutelsat 28A) under a 1999 agreement with Deutsche Telekom AG (“DTAG”), the former licence holder of these rights, before it transferred in 2002 its satellite activity to MB (via a subsidiary of DTAG called T-Systems Business Services).

In October 2012, Eutelsat had commenced arbitral proceedings against SES in relation to the 28.5 degrees East orbital position under the rules of the International Chamber of Commerce (ICC) in Paris. In these arbitral proceedings against SES, Eutelsat has made a number of claims, including seeking a declaration that SES cannot use such frequency bands either from 28.5 degrees East or nearby orbital positions without breaching a 1999 intersystem coordination agreement between Eutelsat and SES.

In a first phase of the proceedings, the Arbitral Tribunal dismissed that specific claim for a declaration on its merits, as requested by SES. In its Partial Award dated September 4, 2013, the Arbitral Tribunal held that the 1999 agreement did not bar SES from using the relevant frequency bands if and when Eutelsat no longer holds the regulatory right to operate in those bands under the German filing. The Tribunal declined to specify the date on which those rights end, on the basis that it only had jurisdiction to interpret the intersystem coordination agreement between SES and Eutelsat and could not pronounce upon any contractual arrangements between Eutelsat and DTAG or MB.

However, this issue of the expiry date has been addressed by the Regional Court of Bonn, Germany in a judgment rendered on August 30, 2013, which was obtained at the request of MB in preliminary injunction proceedings. In accordance with the terms of that judgment Eutelsat is prohibited, as of October 4, 2013, from using any of the frequencies in question, to the extent that this interferes with the use of these frequencies by the holder of the German rights (MB) or by the rightful user (SES).

SES strongly disagrees with Eutelsat’s position on the remaining claims to be decided by the Arbitral Tribunal in the second phase of the arbitration proceedings and will continue to vigorously defend its right to use these frequencies from October 4, 2013. Consequently, SES holds any associated claims for damages and costs to be unfounded and completely without merit or basis.
All SES has to do now is get Astra 2E off the launch pad.

so does this leave Eutelsat with 11.200 to 11.450 then at 28.5e? if so they might aswell sell that sub-band to S.E.S for top dollar. wouldnt suprise me if BSKYB had a great deal of influence on the decision seeing as they are the majority user of the bandwdth on the craft there and their record with N** is far from clean if reports are to be believed. regards mdt

Eutelsat statement on operations at 28.5° East

Paris, 16 September 2013 - The International Chamber of Commerce (ICC) of Paris has drawn its conclusions on the first phase of the arbitration initiated by Eutelsat Communications (Euronext Paris: ETL) against SES in October 2012.

Eutelsat’s request for arbitration was triggered by the claim by SES of the right to use 500 MHz of bandwidth in the 28.2/28.5° East orbital arc according to an agreement signed between SES and Media Broadcast in 2005 and only disclosed in October 2012. This request is grounded on a breach by SES of the Intersystem Coordination Agreement (ICA) signed with Eutelsat in 1999. The ICA signed by both operators covers use of certain orbital positions in Ku frequency bands over Europe and also favours competition in the satellite communications sector.

As a result of this first phase, the Arbitral Tribunal decided that:

The ICA does not bar SES from using the disputed bands if and when Eutelsat does not hold the “regulatory” right to operate in these bands;
SES did agree that Eutelsat would use the disputed bands as long as Eutelsat held the “regulatory” right to operate in these bands.

The Arbitral Tribunal did not decide on whether Eutelsat has the “regulatory” right. Eutelsat firmly believes and can demonstrate it has the “regulatory” right to operate in the disputed frequency bands.

On 30 August 2013, Media Broadcast obtained a preliminary injunction before the Regional Civil Court of Bonn preventing the use by Eutelsat of the disputed frequencies in the event that this creates harmful interference. Eutelsat will appeal this preliminary decision and confirms it does not intend to create harmful interference.

The purpose of the second phase of the arbitration with the ICC is to decide, amongst other issues, whether SES was entitled to sign an agreement in 2005 with Media Broadcast without breaching its obligations under the ICA.

Eutelsat will continue to vigorously defend its right to use the disputed frequencies from 4 October 2013 and to act in the best interests of clients.

As the overall 28.2/28.5° East dispute is ongoing, it is inappropriate to quantify the potential impact on the Group’s outlook provided to the market on 30 July 2013.

Delayed from earlier planned date of July 22 following the loss of a Proton-M carrying three GLONASS satellites 2013 Jul 2.

Delayed further from Sep 16 while discussions took place between Russia and Kazakhstan about completing decontamination of the site where the July 2 Proton rocket crashed. At the same time it became necessary to replace a component in the Proton.

As of Sep 24, Kazakhstan was still saying the launch was not approved.

54th SES satellite to be orbited by ILS Proton

Luxembourg, September 27th, 2013 – SES S.A. (NYSE Euronext Paris and Luxembourg Stock Exchange: SESG) announces that the ASTRA 2E satellite is scheduled for launch on board an ILS Proton launch vehicle from the Baikonur Cosmodrome in Kazakhstan on September 30th, 2013. Liftoff of the Proton launch vehicle is slated for 03:38 am Baikonur time (23:38 CET and 17:38 EDT on September 29).

ASTRA 2E was built for SES by Astrium of France. Based on the highly reliable Eurostar E3000 platform, the spacecraft carries 60 Ku-band transponders, as well as 4 Ka-band transponders. It will enable the delivery of next generation broadcast and broadband services in Europe, the Middle East and Africa from the orbital arc of 28.2/28.5 degrees East. ASTRA 2E will have a launch mass of 6 tonnes, a wingspan of 40m once its solar arrays are deployed in orbit, and a spacecraft power of 13kW at the end of its 15-year design lifetime.

ASTRA 2E will be the seventh Eurostar satellite in the SES fleet, following the successful launch of SES-6 in June 2013 and ASTRA 2F in September 2012.

A live broadcast of the launch in high definition quality will be available via ASTRA at the orbital position of 19.2 degrees East, channel 1.037, downlink frequency 11023.25 MHz, horizontal polarization, Symbol rate 22.00 MSym/s, FEC 5/6, service ID 5221, service name ASTRA 2E Launch.

A webcast will also be available via www.ilslaunch.com. The video transmission of the launch of ASTRA 2E will begin approximately 30 minutes before liftoff.

Successful Launch of Astra 2E @ 22:40 last night,

Astra 2E Separation achieved today,

We have had a successful mission with the Proton M Breeze M rocket, carrying the ASTRA 2E satellite built by Astrium for SES. We have had confirmation that the satellite separated from the vehicle on schedule at 2:50 AM Eastern Time, or 06:50 GMT, 9 hours and 12 minutes after liftoff.

Everything occurred as planned with ignition, shutdown and separation of the Proton’s first three stages. Then the Breeze M upper stage with the satellite continued the mission, igniting five times, and then releasing the satellite into transfer orbit.

Astra 2E will now move to 43.5 east for testing,

Astra 2E will move to 28.2 east within the next 5 weeks,

On the arrival of Astra 2E @ 28.2 east Astra 1N will then move to 19.2 east.

The same cannot be said for the new European Beams from Astra 2E,2F & 2G see below,

Some Euopeans will have to wait for Astra 2G for 70cm dish reception in Italy & some parts of Eastern Europe.
