Victory for TF1 and LCI in Dailymotion case

The Paris Commercial Court has ruled that French private broadcaster TF1 and LCI were right in their complaints that online video portal Dailymotion has been using their content without consent.

Dailymotion argued that they are just a host for videos and have no editorial control over the content. The company also proposed that private broadcasters such as TF1 and the LCI news channel would introduce fingerprinting to make it easier for the portal to remove content.

When TF1 started proceedings the broadcaster asked for €80 million in damages. The court has now ruled in the broadcaster’s favour, but awarded damages to the tune of €200,000 to TF1, €20,000 to LCI, €30,000 to KS2 Productions and another €8,000 to producer to Gad Elmaleh.

Dailymotion has to remove all contested videos as well as take precautions that content from the broadcasters and production companies will not appear again on the portal.
